Jan. 29: Pandemic-era overpayment waiver update

Updated January 29, 2024


The Employment Security Department has implemented expanded rules for waiving overpayments from weeks claimed during the COVID-19 pandemic — between Feb. 2, 2020, to Sept. 4, 2021. We implemented these expanded rules under federal guidance. ESD cannot waive all overpayments. But we are looking for every opportunity to provide relief to those severely impacted by these overpayments.

We are now processing waiver applications

The waiver request form is available online in eServices and by phone. Submit the form if you believe you have a pandemic-era overpayment or if we have informed you that you have one.

We will manually review your waiver request form and other information in your claim file. We also may contact you or your employer. This process will take time. We will let you know if your application shows that you qualify for a waiver or not after we complete the review. If we are unable to waive your overpayment, we will notify you about other options you can pursue.

Request a waiver in eServices

The best and fastest way to submit a waiver request is through eServices.

Log onto eServices:

  1. Go to secure.esd.wa.gov.
  2. Log into SecureAccess Washington (SAW).

Access the waiver request form:

  1. In eServices, find the I want to column in the upper right corner.
  2. Select Submit pandemic era overpayment waiver request.
  3. Carefully read the contents of each screen and answer the questions in the form.
  4. Select Submit after you have completed it.

Edit, view, delete or check the status your request:

  1. In eServices, find the I want to column in the upper right corner.
  2. Select Submit pandemic era overpayment waiver request.
  3. You can:
    • View the status of your request in the Status
    • Select View Submission, Edit Submission or Delete Submission in the I want to

Request a waiver by phone

If you are unable to request a waiver online, our agents can help you complete and submit the form by phone. Call 800-318-6022 Monday through Friday from 8 a.m. to 4 p.m. except holidays.

Reasonable accommodation

Employment Security is committed to providing equal access to benefits and services. Visit our reasonable accommodation page for additional help if you are:

  • An individual with a disability.
  • In unusual circumstances that make submitting a waiver request in eServices difficult.


In most circumstances, you will receive a refund if you already made payments on your pandemic-era overpayment and we decide to waive it. The refund will go to the payment method we have on file.

If you get a waiver, you may receive your refund within six weeks of being notified of the waiver.

Please note

You may have received a letter or email from ESD if you have an outstanding overpayment from the pandemic era. You may have also received one if you had an overpayment from the pandemic era, but:

  • You already paid back the overpayment.
  • ESD offset the overpayment from your benefit payments.

If you had an overpayment but you already repaid it or ESD offset it, you may be eligible for a refund if you apply for a waiver.

Interest on your overpayment

If we waive your overpayment, we will also waive any interest associated with that overpayment. If you do not qualify for a waiver, you will need to pay interest on any overpayment for regular unemployment benefits. You will not have to pay interest on overpayments for PUA, PEUC, FPUC or MEUC .

  • PEUC – Pandemic Emergency Unemployment Compensation
  • FPUC – Federal Pandemic Unemployment Compensation
  • MEUC - Mixed Earner Unemployment Compensation

Repayment plans

While you wait to hear about your waiver request, you can set up a payment plan to start repaying your overpayment. You can set up a repayment plan by calling the Employment Security Collections Unit at 866-697-4831.

You can request the reversal of a waiver

If we granted you a waiver of your pandemic-era overpayment, you can request that we reverse our decision and reinstate the overpayment. You can fill out and submit a waiver reversal form. If we reverse your waiver, you will need to pay us back for the full amount that was reversed.
